These Terms and Conditions (“Terms”) apply to purchases made through this website (“Site”). By placing an order, you agree to these Terms.

1) About us

2) Definitions

  • “In‑stock items” means framed prints and/or prints that are already made and held in stock at the time you order.
  • “Bespoke items” means any product made to your specifications or clearly personalised (for example: custom size, custom frame/mount combination not offered as standard, custom colour edits, custom cropping, custom text, made-to-order with choices you select beyond standard options, or any commissioned artwork).
  • “Working day” means Monday to Friday (excluding UK bank holidays).

3) Ordering

  • Orders are placed via the checkout on our Site.
  • Please check your order carefully before submitting, including delivery address, selected product, frame choice, and quantity.
  • We reserve the right to refuse or cancel an order (for example, due to errors in pricing/stock, suspected fraud, or delivery restrictions). If we cancel after payment, we will refund you.

4) Prices and payment

  • Prices are shown in GBP.
  • Delivery charges are shown at checkout.
  • Payment is taken at the time you place your order using the payment methods shown at checkout.

5) Product descriptions, colours and mounting

  • We aim to display product images and colours as accurately as possible. However, colours can vary between screen displays and printed products.
  • Where dimensions of prints, frames or other components are stated, minor tolerances may apply (for example, due to the printing, framing and manufacturing process). If you require an exact size of any component, you should confirm this with us before placing your order.
  • Larger prints may be fixed to the frame backboard to prevent warping or rippling. This means if you later intend to re-frame them, you should either use the same backboard in the new picture frame or buy the print only version of the picture from us.

6) Availability

  • In‑stock items are subject to availability. If an in‑stock item becomes unavailable after you order, we will contact you and offer a refund or an alternative where possible.
  • Bespoke items are made to order and will have lead times stated on the product page or at checkout.

7) Delivery

  • Delivery options, costs, and estimated delivery times are shown at checkout.
  • Print-only orders are sent in cardboard postal tubes. Framed prints are sealed in bubble-wrap and then placed into a cardboard box.
  • Delivery times are estimates and not guaranteed.
  • Risk of loss/damage passes to you when the goods are delivered to the address you provided (or collected by you).
  • Please inspect items on delivery and notify us as soon as possible of any damage.

Damaged deliveries

  • If packaging is visibly damaged, please take photos before opening (where possible).
  • If your item arrives damaged, contact us within 48 hours of delivery with photos of: the outer packaging, inner packaging, and the damage to the product.

8) Consumer right to cancel (distance selling) – In‑stock items

If you are a UK consumer buying online/at a distance, you typically have a legal right to cancel in‑stock items within 14 days (of delivery of the goods) without giving a reason. This section applies to in‑stock items only. (See Section 9 for bespoke items.)

How to cancel (in‑stock items)

To cancel, tell us clearly that you want to cancel your order. You can do this by email to: support@capway.uk.
Please include: your name, your order number, what you bought, and the delivery date.

Returns process (in‑stock items)

  • After you notify us that you are cancelling, you must return the goods to us within 14 days.
  • You are responsible for the cost of return and safe return of the goods, unless we agree otherwise.
  • You must take reasonable care of the goods while you have them. If the goods are not in saleable condition when we receive them, we may reduce your refund to reflect any loss in value.

Refunds (in‑stock items)

  • If you cancel within the cancellation period, we will refund the price you paid for the goods.
  • We will also refund the standard outbound delivery charge (if you paid extra for an enhanced delivery option, we only refund the cost of the standard delivery option).
  • We will process the refund once we receive the goods back.
  • Refunds are made to the original payment method.

Exclusions/notes

  • If you have ordered multiple items and only cancel part of the order, delivery refunds will be handled in line with the above rules (i.e., standard delivery is refunded only where applicable).
  • This cancellation right is separate from your rights if goods are faulty (see Section 10).

9) Bespoke / made-to-order items – No 14‑day cancellation for “change of mind”

Bespoke items are excluded from the 14‑day cancellation right where they are made to your specifications or clearly personalised.

This means:

  • Once production has begun – or once the bespoke specification has been confirmed – you cannot cancel for a change of mind.
  • You remain protected if the item is faulty or not as described (see Section 10).

Examples of bespoke items (non-exhaustive):

  • Custom size not offered as a standard option on our website.
  • Custom frame/mount combinations not offered as standard.
  • Products specified as made-to-order on our website
  • Custom edits, custom text, personalised elements, or commissioned work.
  • Any made-to-order print created specifically to your selections outside our standard catalogue.

10) Faulty, damaged, or not-as-described items

Nothing in these Terms affects your legal rights.

We take care to ensure that all products supplied by Capway Art are of satisfactory quality, fit for their intended purpose and as described.

In addition to your statutory rights, we provide a general warranty on physical goods for a period of 12 months from the date of delivery (“Warranty Period”). During the Warranty Period, if a product is found to be defective due to faulty materials or workmanship (a “Warranty Defect”), we will, at our option:

  • repair the product;
  • replace the product; or
  • provide a full or partial refund (which may take account of any use you have had of the product where appropriate).

What the warranty covers

This warranty covers manufacturing faults and defects that were present at the time of delivery or that arise during the Warranty Period as a result of faulty materials or workmanship.

What the warranty does not cover

This warranty does not cover:

  • normal wear and tear;
  • accidental damage, misuse, neglect or improper handling;
  • damage caused by failure to follow care, handling, hanging, cleaning or storage instructions (including exposure to excessive heat, moisture, direct sunlight, or unsuitable environments);
  • changes in appearance caused by the natural ageing of materials (including paper, inks, mounts and frames);
  • damage caused by third parties (including couriers after delivery, installers/hangers, or repair attempts by anyone other than us);
  • defects caused by alterations, tampering or attempted repairs;
  • issues that are specifically disclosed on the product page or agreed in writing at the time of purchase; or
  • dissatisfaction with aesthetics (e.g., colour/finish choices) where the product is otherwise as described.

How to make a warranty claim

To make a warranty claim, please contact us within the Warranty Period and provide:

  • your order number and delivery address;
  • a description of the issue; and
  • clear photographs showing the defect and the item overall (including any packaging if the item arrived damaged).

We may ask you to return the item for inspection. Unless otherwise required by law, you are responsible for return postage for warranty claims where no Warranty Defect is found; where a Warranty Defect is confirmed, we will reimburse reasonable return postage costs (or provide a prepaid return method).

Statutory rights

Nothing in this warranty limits or excludes your legal rights under UK consumer law (including your rights in relation to goods that are faulty or not as described).

If your item is faulty/damaged

  • Contact us as soon as possible with your order number and photos.
  • If the product is faulty or not as described, you may be entitled to a repair, replacement, or refund under UK consumer law.
  • If we ask you to return an item due to a fault, we will cover reasonable return postage costs (or arrange collection) where appropriate.

12) Intellectual property

All images, designs, and content on this Site are owned by or licensed to Capway Art. You must not copy, reproduce, or distribute our content without written permission.

13) Limitation of liability

  • We do not exclude or limit liability where it would be unlawful to do so (including for death or personal injury caused by negligence, fraud, or for breach of your statutory rights).
  • Subject to the above, our total liability for losses relating to your order is limited to the amount you paid for the product(s) in that order.
  • We are not responsible for losses that are not foreseeable.

14) Events outside our control

We are not liable for delays or failure to perform caused by events outside our reasonable control (e.g., postage/courier disruption, extreme weather, supply issues, or other force majeure events).

17) Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales.
